What is the Employee Retention Credit (ERC)?

The Employee Return Credit is an IRS payroll credit designed to help small businesses retain their employees during difficult times.

The credit is included on your quarterly payroll tax filings and is refundable to businesses.

Who Qualifies?

You may qualify if your business was impacted by COVID-19 in one of the following ways:

Government shutdown orders mandated you partially or fully close your business at any time in 2020 or 2021.
Gross income declined in 2020 or 2021. Criteria is different for each year but it compares quarters in 2019, 2020, and 2021.
New businesses established after February 15, 2020.

How Much Can I Receive?

This credit is for small businesses. In 2020 you need to have less than 100 employees; in 2021 you need to have less than 500 employees.

For 2020, you can claim up to $5,000 per employee.
For 2021, you can claim up to $7,000 per employee per quarter.
